Mr. Hayden is a member of the International Academy of Trial Attorneys and is a member of the American College of Trial Lawyers. Mr. Hayden is a magna cum laude graduate of Rutgers Law School. He served for one year as a law secretary to the Chief Justice of the New Jersey Supreme Court. He is a member of the New York and New Jersey Bars.

He served as a Deputy Attorney General in the Organized Crime and Special Prosecution Section of the Division of Criminal Justice, where he tried the first wiretap case brought by the State in 1970. He served as counsel to the Essex County Democratic Party as well as counsel to the campaign and Transition Committee of Mayor Glenn Cunningham of Jersey City. He is a past president of the Association of the Federal Bar. He was a founder and first President of the Association of Criminal Defense Lawyers of New Jersey. He served on the New Jersey State Bar Association Judicial Prosecutorial Appointments Committee. He was appointed to the Lawyers Advisory Committee to the United States Circuit Court of Appeals for the Third Circuit. He was appointed by the chief judge of the United States District Court of New Jersey to the District Court's Lawyers Advisory Committee. He is also an editor of the New Jersey Law Journal.

He is a recipient of the Trial Bar Award for professional excellence from the Trial Attorneys of New Jersey (a civil litigators' organization) and the Lawrence A. Whipple Award for professional excellence from the New Jersey Association of Criminal Defense Attorneys. In 2004 he was selected as the Professional Lawyer of the Year in the area of Criminal Law by the New Jersey Commission on Professionalism in the Law. He concentrates on complex litigation, where many of his cases have received attention on television or print media, but some of his best results have been cases where a client was investigated but never prosecuted.

Joseph Hayden has been named as one of the Top 100 Attorneys in New Jersey Super Lawyer, New Jersey Monthly Magazine for a number of years and one of the Top 10 Attorneys in New Jersey Super Lawyer, New Jersey Monthly Magazine on three occasions. He is recognized in the field of White Collar and Non-White Collar Criminal Defense in the 2010 edition of Best Lawyers in America. He is named the New York Area's Lawyer of the Year as published in New York Magazine for 2011 as Lawyer of the Year for White Collar Criminal Practice. Mr. Hayden is the recipient of the 2011 Distinguished Alumnus Award from Rutgers School of Law-Newark.
